Phase I & II Environmental Site Assessment

We preform Phase I & II Environmental Site Assessments in conformance with the practices outlined in ASTM 1527-05 and 1903-97. An Environmental Site Assessment (ESA) is a report identifying potential or existing environmental contamination liabilities. The analysis addresses both the underlying land as well as physical property improvements. If a potential environmental concern has been identified on property that you own or are interested in purchasing, we will review your concerns and provide a detailed proposal to determine the most cost-effective methods of mitigation. If you have an environmental report or remedial proposal relative to your property that you are not comfortable with, we will review those documents and provide you with our interpretation. We can frequently provide alternative remedial options or less expensive methods to address your environmental concern.

We adhere to the following procedures when conducting Phase I ESA

 

Phase I ESA Procedures

 

  • The subject site and adjacent parcels are thoroughly inspected, investigated and evaluated according to the ASTM 1527-05 All Appropriate Inquiry (AAI) Standard.
  • The subject site owner or owner’s representative is interviewed relative to the current and historic site use, regulated activities, petroleum or chemical storage, waste generation, unpermitted discharge, and any other activities that have potential environmental impact on site conditions.
  • A records review of property ownership is performed to determine whether any historic or current site usage is considered a recognized environmental concern.
  • The locations of federal, state, and local regulated sites are reviewed with respect to the ASTM-specified search distances relative to the subject site.
  • Historic aerial photograph and Polk Directory review of the site.
  • An evaluation and interpretation of potential underground storage tank presence, drywells, illegal waste disposal, or illegal discharge points originating or terminating at the subject site.
  • Non-scope items that are commented on relative to recommended Phase II studies include suspected asbestos–containing materials, lead-based paint, regulated wetland areas, radon, indoor air quality, and mold presence.
  • A confidential report summary of the subject site is prepared and includes the Environmental Professional’s summary of findings, recommendations, and conclusions.

Phase I

 

 

Phase I ESA characterizes the subject site with respect to recognized environmental conditions in connection with the property, including the range of contaminants within the scope of the ASTM 1527-05 AAI Standard and the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) and petroleum products. This assessment is intended to permit a user to satisfy one of the requirements to qualify for the innocent landowner defense to CERCLA liability: that is, the practices that constitute “all property consistent with good commercial or customary practice” as defined in 42 USC § 9601 (35) (B).If conditions warrant additional investigation, a written Phase II ESA proposal will be prepared upon request. The proposal will describe the means for identifying and characterizing environmental contamination revealed during the Phase I ESA.

Phase II

 

Phase II ESA evaluates the recognized environmental conditions identified in the Phase I. If contamination is identified, the Phase II work will be conducted to define the nature and extent of contamination. Phase II provides the level of knowledge necessary to satisfy the innocent purchaser defense under CERCLA.

  • Underground storage tank removals in compliance with NYSDEC Petroleum Bulk Storage Regulations
  • Contaminated soil and/or groundwater remediation (including bioremediation) to obtain NYSDEC spill closure
  • Lead paint inspections
  • Radon investigations and mitigation
  • Wetland delineation
  • Indoor Air Quality (IAQ)
  • Mold investigation
